सरकारों की चूक और उनके कृत्य के लिए झुग्गी वासियों को दंडित नहीं किया जा सकता- सीपीआई(एम)

श्रीमान बैजल जी,
मैं यह पत्र आपको हालिया सर्वोच्च न्यायालय के फैसले के बाद बन गई गंभीर स्थिति के बारे में बताने के लिए लिख रहा हूँ, जिसमें रेलवे की पटरियों से सटे रेलवे की जमीन पर झुग्गी बस्तियों को हटाने का निर्देश दिया गया था। यह अनुमान है कि दिल्ली में लगभग 48,000 झुग्गियों में रहने वाले 2.5 लाख से अधिक लोग इस अमानवीय आदेश से प्रभावित होंगे। इस आदेश के लागू होने पर लाखों महिलाएँ, बच्चे और बूढ़े बेघर हो जाएंगे। यह आदेश ऐसे समय में आया है जब दिल्ली कोविद -19 संक्रमण की दूसरी लहर से जूझ रही है और झुग्गी वासियों को आर्थिक मंदी और अनियोजित लॉकडाउन के कारण व्यापक बेरोजगारी का सामना करना पड़ रहा है। झुग्गियों को उजाड़ने से मामला और भी खराब हो जाएगा।
मैं आपका ध्यान पिछले साल के दिल्ली उच्च न्यायालय के आदेश की ओर भी आकर्षित करना चाहता हूँ, जिसमें कहा गया है कि झुग्गी बस्तियों को उजाड़ने की स्थिति में पुनर्वास की व्यवस्था की जानी चाहिए। झुग्गीवासियों का या तो उसी स्थान पर पुनर्वास या फिर अंतिम उपाय के तौर पर उनके स्थानांतरण का विकल्प दिए बिना उन्हें उजाड़ना सैद्धांतिक रूप से विभिन्न केंद्रीय सरकारों के नीतिगत ढांचे में स्वीकार नहीं किया गया है।
लोग अपनी चाहत के कारण झुग्गियों में नहीं रहते, बल्कि लगातार केंद्र सरकारों की त्रुटिपूर्ण और गरीब विरोधी नीतियों के कारण उन्हें ऐसा करने के लिए मजबूर किया जाता है। इन सरकारों की चूक और उनके कृत्य के लिए झुग्गी वासियों को दंडित नहीं किया जा सकता। इसलिए, सीपीआई(एम) मांग करती है कि किसी भी झुग्गी वासियों को वैकल्पिक व्यवस्था, पुनर्वास और मुआवजे के बिना बेदखल न किया जाए। हम यह भी मांग करते हैं कि आप केंद्र सरकार को इस बात के लिए राजी करें कि वह तुरंत इस संदर्भ में एक अध्यादेश लाए जो उच्चतम न्यायालय के उपरोक्त अमानवीय आदेश को समाप्त करता हो।

Dear Baijal ji,
I am writing this letter to apprise you about the grave situation created after the recent Supreme Court verdict directing removal of jhuggi dwellings on railway land adjacent to railway tracks. It is estimated that more than 2.5 lakh people residing in around 48,000 jhuggi dwellings in Delhi will be affected by this inhuman order. Lacs of women, children and the aged would become homeless if this order is implemented. To make matters worse, the order comes at a time when Delhi is grappling with a second wave of Covid-19 infections and jhuggi dwellers are facing widespread unemployment due to the economic downturn and unplanned lockdown.
May I also draw your attention to the Delhi High Court order of last year directing that arrangements for rehabilitation must be made in the event of relocation of slums. The principle of no eviction without first providing for either in situ rehabilitation of slum dwellers or in the last resort relocation has been accepted in policy frameworks of different central governments.
It is for the Lieutenant Governor of Delhi as the constitutional head along with the Delhi government to work with the railway ministry for an amicable solution in the matter. On behalf of the Delhi State Committee of the Communist Party of India (Marxist), I appeal to you to make every possible effort to prevent eviction of jhuggi dwellers without relocation, rehabilitation and compensation. People do not live in jhuggis out of choice. They are forced to do so because of flawed and anti-poor housing policies of successive central governments. They must not be penalized for acts of omission and commission of these governments.
